He will have to compensate the insurance company of which he was a client and pay 700,000 euros, plus 35,000 in legal fees, for the centaur who on the night between 1 and 2 June 2010 ran over and killed Lorenzo Guarnieri, a 17-year-old high school student on a motorbike. This is what was established by the Court of Appeal of Florence. The news was reported by the newspaper Il Tirreno. The man had drunk enough alcohol to prevent him from driving, at least on paper. And then the further load of psychotropic drugs and ascertained narcotics, at least three times the limit beyond which one enters the positivity to narcotics. What were the conditions of the motorcyclist who overwhelmed and killed the 17-year-old, the criminal trial had already told. A definitive sentence, with abbreviated procedure, to 2 years and 8 months confirmed in Cassation.

From that tragedy on the road, a national awareness campaign was launched capable of modifying the penal code with the introduction of the crime of road homicide (March 2016). The amount is that compensated to the victim’s family members. Denied, we still read in the newspaper, in the first instance, the company’s recourse to the insured – for testing positive for alcohol and drugs at the time of the accident – is now recognized on appeal.

Those clauses of the contract were not vexatious, as written in the first sentence. It was clear and shared at the time of signing the policy that, in the event of an accident, coverage would cease to exist if the policyholder tested positive for alcohol and drugs. From that accident, the Lorenzo Guarnieri Association was born in 2010 to remember Lorenzo himself and to save road victims by promoting prevention activities and involving administrations and public opinion.
