“From the Court of Cassation comes a very important assistance in favor of millions of Italian motorists who suffer damage to their cars following road accidents”.
This was stated by Assoutenti commenting in a note on the recent order of the civil section of the Cassation which expressed itself on the right of the policyholders to obtain the right compensation even when the value of the compensation exceeds the commercial value of the damaged car.
“Until now, motorists have been pushed by insurance companies to scrap their cars when the costs of repairs were uneconomical for the companies, as they were higher than the market value of the damaged car. An incorrect practice that violates consumers’ rights – he explains the president Furio Truzzi – forced to buy a new car despite being able to repair the damaged one. Now the Cassation is putting an end to this absurd policy of the insurance companies, and motorists will be able to rightfully repair their car even if the company claims it has a commercial value too low, avoiding resorting to scrapping and bearing the ever more demanding burden of having to buy a new car”.
