Collect 117 fines for Ztl entry, judge annuls 104

The judge of the Palermo court Emanuela Piazza partially accepted the appeal of a motorist who had received 117 fines for entering the Ztl by car without a pass. In the end, you will only have to pay 13. The other 104 have been canceled because the minutes were notified late by the Municipality of Palermo.

The fines were all taken between 2017 and 2018.

On her way home to work, the woman, who takes care of the children, had entered the restricted traffic zone several times, established a few months earlier, mostly passing through the gates of via Roma and via Lincoln and not realizing, according to her, to have ended up in a contravention. The justice of the peace had sentenced the woman to pay all the fines for around 8,000 euros. The woman defended by the lawyer Manuela Lo Cascio presented an appeal and the appeal was largely accepted.

“It should be noted – the judge reasons – that they have not all been duly notified within the term prescribed by article 201 of the Highway Code”, which allows 90 days for notification to start from the ascertainment of the violation.

The important thing is that the Administration entrusts the package to the postal service quickly, or in any case within the deadline, not being liable for any delays due to other reasons”.
