Russia’s war against Ukraine forced Ukrainians to forget about ordinary life and drastically change their place of residence, work, flee from shelling, or even go abroad. In such extreme conditions, people are forced to temporarily leave their jobs.

The Center for Counteracting Disinformation under the National Security and Defense Council of Ukraine and the Association YurFem explain whether employers can fire people for not showing up for work during hostilities

Are there grounds for dismissal for not showing up for work?

in labor law there is no such ground for release as war.

There are several classifications of what employees may not get in touch with:

  • “NZ” (“failure to appear for unexplained reasons”);
  • “ІВ” (“other types of absenteeism provided for by collective agreements, agreements”);
  • “І” (“other reasons for non-attendance”).

The state asks not to fire people during the war. but even if dismissal occurs, the law does not provide for liability for this.

However, there is an option that some cases of dismissal can be challenged in court.

What should employees do

If communication between the worker and the employer is established, and both parties have reported their actions during the war, the employee can:

  • take one of the holidays provided for by law;
  • arrange remote work: the employer can offer remote or home work or flexible working hours;
  • if the employee(s) are subject to mobilization, the Law guarantees the preservation of the workplace and average earnings.

The National Security and Defense Council explains that remote work is:

A form of labor organization when a person works outside the office using information and communication technologies. In this case, the employee independently determines the workplace and is responsible for ensuring safe and harmless working conditions.

And homework means the following:

The work is performed by the employee at his place of residence or in other premises where there will be access to everything for performing work outside the production or working premises of the owner of the enterprise, institution, organization or body authorized by him.

Also have flexible working hours, when a person can work according to a different mode of work than specified in the internal labor regulations.

“The employer must make sure that the employee can safely perform the assigned work at home, the employee has the appropriate equipment and tools for safe work, appropriate protective equipment and devices. If the employee has a disability, the employer must take care of arranging the workplace, as well as take measures to ensure physical and psychological health of employees, explained in the National Security and Defense Council.

Flexible working hours do not affect the formation of wages, bonuses, and the calculation of seniority. In this case, the duration of the shift cannot exceed 12 hours per day. And for women with children no more than 10 hours.

Unemployment in Russia due to the war against Ukraine

Earlier, Segodnya was told that the sanctions of Western partners led to the fact that the Russians began to lose their jobs at enterprises that had left the Russian market.

For example, the closure of Ikea resulted in the loss 15 thousand jobsand the Renault-Nissan plant in Togliatti, which stopped due to a lack of imported parts, – this is 35 thousand jobs.

In total, due to the shutdown of enterprises, the Russians have already lost 81 thousand jobs, and this is just the beginning.
