Orlando: ‘Compensated parental leave up to 12 years’

Wilhelm Schmid:

The Government has approved two draft legislative decrees for the transposition of European directives that “extend workers’ rights and introduce measures for the improvement of living and working conditions”. This was announced by the Minister of Labor, Andrea Orlando with a note in which he emphasizes that among the rules there is an increase in the age limit of the child from 6 to 12 years for which partially compensated parental leave can be requested. In addition the months of parental leave covered by allowance (30% of the salary) are increased from six to nine in total.

Then the right to parental leave for the single parent will be extended from 10 to 11 months. This is what is foreseen by one of the two draft legislative decrees approved today by the Council of Ministers for the transposition of EU directives. Until now, the extension to 11 months was valid only in the case of use by both parents with the use of five months by the father.

“The level of the relative indemnity – Orlando explains in a note – is 30 per cent of the salary, to the extent of three non-transferable months for each parent, for a total period of six months. To this is added a further period of three months, transferable between the parents and usable alternatively between them, to which an allowance equal to 30% of the salary is connected. Therefore, without prejudice to the maximum limits of parental leave available to parents, the months of parental leave covered by allowances have increased from six to nine in total. The allowance payable to parents, alternatively between them, for the period of extension of up to three years of parental leave taken for the severely disabled child, is 30% “.

Orlando specifies that “the age of the child by which the parents, also adoptive and foster carerscan take advantage of parental leave, compensated in the terms just described “and that” the right to maternity allowance has been extended in favor of self-employed workers and freelancers respectively, also for any periods of early abstention due to pregnancy at risk ” .
