During martial law in Ukraine, many rules have changed, in particular, some authorized persons have received more rights to check citizens. So, at checkpoints, someone can check things.

On the Free Legal Aid portal, they told what exactly they can inspect and who has the right to do so.

Checking at roadblocks is legal

The grounds for such a check are spelled out in the Constitution of Ukraine, the Criminal Procedure Code of Ukraine, the Code of Administrative Offenses of Ukraine, as well as in several laws. However, it is important to understand that such verification can take place only under martial law.

This can be done by authorized persons of the following structures:

  • the National Police;
  • SBU;
  • the National Guard;
  • State Border Service;
  • migration service;
  • customs service;
  • APU.

What can be checked

At the roadblock you can view the following:

  • documentation;
  • things;
  • vehicles;
  • baggage and cargo.

Authorized persons may use various devices and means during inspection to detect explosive objects and substances. They can also conduct photo, audio and video recordings, however, the last two can take place only with the consent of the inspected citizens.

The phone can also be checked, although the law does not describe the procedures for this.

“The legislation does not regulate this issue, but since Article 114 of the CCU provides for criminal liability for unauthorized dissemination of information about the direction, movement of weapons, weapons and ammunition to Ukraine, the movement, movement or deployment of the Armed Forces of Ukraine or other military formations, committed in a state of martial law or a state of emergency “, then an authorized person at the checkpoint can check photos and videos for the presence of prohibited objects on the respective devices. It should also be noted that the law does not regulate the issue of personal correspondence, therefore, in order to avoid conflict situations, we advise you to provide means of communication for inspection,” the lawyers say.

At checkpoints, they can also hand over a summons. The law does not specify a specific place where exactly this should take place, and therefore the summons can be served anywhere.

How property can be confiscated in Ukraine during the war

Previously, “Today” explained that a legal or natural person can be deprived of the right to own certain property. It can be, for example, transport. It is transferred to the ownership of the state and used in a state of war or a state of emergency.

In peaceful territory during martial law, property can only be taken after the agreement of the military command and the executive committee or military administration. However, in the territory where hostilities are taking place, the military command can do it on its own. without further approval.
