Not only the unemployed: who will be affected by labor service during the war

In Ukraine, during martial law, the officially registered unemployed will be involved in various types of public works at the request of local authorities.

UBR.ua experts told how this can work and who will not be affected.

So, in peacetime, a vacancy corresponding to the education, qualifications and experience gained by the applicant in previous jobs was considered a suitable offer from the Employment Center.


However, the war changed this process and now the labor exchange is obliged to offer jobs with such characteristics. only in the first 30 days from the date of registration of the unemployed.

Further, all these requirements are canceled and the applicant can be offered any job that does not correspond to his professional skills, the same situation with salary.

According to the current information from the government, the unemployed may begin to be attracted to two different categories of public works – socially useful (what Shmyhal is talking about) and public (this is a type on a voluntary basis).

Leonid Gorshenin, a lawyer for JSC Chudovsky and Partners, said that such types of work are regulated by a separate Procedure for wartime.

They must be done for:

  • meet the needs of the armed forces and law enforcement agencies;
  • ensuring the operation of critical infrastructure;
  • functioning of the national economy.

“Publicly useful work can be involuntary (performed as part of labor conscription). Labor conscription is authorized to be introduced by the military command together with military administrations (if created) independently or with the involvement of executive authorities and local self-government,” the lawyer emphasizes.

Gorshenin says that people can be involved in socially useful work not only the unemployedbut also employed persons, in agreement with the employer and with the preservation of the place of work, as well as students, self-employed, employed in a personal farm.

Evasion of labor service threatens with administrative liability in the form of a fine of up to UAH 5100 for citizens and UAH 8500 for officials.

Who won’t get hired?

According to lawyers, a person cannot be involved in such types of work if contraindications for health reasonsit is also forbidden to involve:

  • minors under the age of 15 inclusive;
  • women raising children under the age of 3;
  • pregnant women, if the performance of work may adversely affect their health.
