Zelensky legalized compensation for destroyed housing: when can I get and how the mechanism will work

President of Ukraine Volodymyr Zelensky signed a law on compensation for destroyed and damaged housing as a result of hostilities. First Citizens will be able to receive compensation in May.

Payouts will be provided exclusively for damaged or destroyed from February 24, 2022 residential real estate, but this does not apply to objects located in the temporarily occupied territories on the date of the introduction of martial law. Draft Law No. 7198 is available on the website of the Verkhovna Rada.

Compensation will be provided for destroyed and damaged apartments, other living quarters (for example, dormitory rooms), manor-type houses, garden and country houses, construction objects in which supporting and external structures are built. The common property of an apartment building will also be compensated – but only if it is damaged.

Who can receive compensation?

Individuals-citizens of Ukraine who own property will be entitled to compensation. At the same time, a number of people will not be able to count on it. In particular:

  • from sanctions lists;
  • with a conviction for committing crimes against the foundations of national security;
  • their heirs.

The certificate can be used for 5 years from the date of issue. Alienation within 5 years, except for inheritance, is prohibited.

Sources of funding for compensation for damaged and destroyed property:

  1. Funds from the state and local budgets;
  2. funds of international financial organizations, other creditors and investors;
  3. international technical and/or repayable or non-refundable financial assistance;
  4. reparations or other penalties from the terrorist country of the Russian Federation;
  5. other sources not prohibited by the legislation of Ukraine, including local funds established to provide compensation and restore damaged/destroyed (destroyed) real estate objects.

According to the people’s deputy, chairman of the Servant of the People party Olena Shulyak, more than 1 million Ukrainians are left without housing today. As of the beginning of March, Ukrainians have already filed 335 thousand applications for damage or destruction of housing through the Action portal.

The current volume of declared destruction is about 23 million square meters. m, while most of all declared in the Donetsk, Kharkov and Kyiv regions. More than 500 communities have already been registered in the register of damaged property, data on 10 thousand objects have been entered.

As GLOBAL HAPPENINGS wrote earlier, in Ukraine the average price per square meter increased by about a third over the year. Compared to the cost in December 2021 and December 2022, the median price for a primary property in the country increased by 29% and amounted to UAH 28,534/sq. m.
