the minister Alexandre de Moraes, of Federal Supreme Court (STF), authorized the return of the senator’s cell phone Marcos do Val (Podemos-ES).

The decision responds to a request made by the Federal policewho said he had already extracted the data from the device necessary for the investigation.

The senator is investigated after having declared that he participated in a meeting with the former president Jair Bolsonaro and the former deputy Daniel Silveira, which aimed to record conversations with Minister Alexandre de Moraes to embarrass him and compromise the outcome of the elections.

“The Federal Police requested authorization to return the cell phone – spontaneously provided by Marcos do Val – because it had already extracted the data. In view of this, pursuant to art. 118 of the Code of Criminal Procedure, I authorize the return of Marcos do Val’s cell phone”, says Moraes in the decision.

In addition to the PF, the Advocacy General of the Federal Senate filed a request requesting the return of the device.

Investigation

Last Friday (3), Moraes ordered the opening of an investigation to investigate Marcos do Val’s statements.

Minister Alexandre de Moraes alleges that the senator presented a different version of the facts when heard by the Federal Police and, therefore, the investigation of crimes of false testimony, slander and coercion in the process should be carried out. “After the hearing, the rapporteur found that the senator presented four antagonistic versions of the fact, the last one in a statement to the PF, which demonstrates the “pertinence and necessity” of carrying out diligences for its complete clarification and for the investigation of the crimes. of false testimony, slanderous denunciation and coercion in the course of the process”.
