Haddad assesses betting site taxation; understand proposal

After the presentation of the fiscal framework, last Thursday (30), the government is maturing measures to increase federal revenue and comply with what was proposed by Fernando Haddad, finance Minister. The folder foresees measures with an impact of up to R$ 150 billion in 12 months.

The information is from O Globo. According to the newspaper, between Among the measures announced by Haddad is the taxation of online betting, with an expected annual revenue of up to R$ 6 billion.

Rodolfo Tamanaha, digital business partner at Madrona Fialho Advogados, comments that the move would require a legal framework very similar to that of cryptocurrencies.

This is because, currently, betting sites do not have a CNPJ in Brazil, but operate in the territory through the internet.

More taxation on online betting site

Companies that operate in Brazil and offer this type of bet are already taxed, according to the lawyer. Law 13,756 of 2018 already provides for the allocation of proceeds from lottery collections.

“What seems to me to be the point are companies outside Brazil. In them, the expectation is for a higher collection, because there are transactions in the order of billions”, he says.

The government wants to tax online sports betting, mainly on football results, also called sports betting. The measure would not include video games or electronic sports, called e-sports.
