(ANSA) – NAPLES, FEBRUARY 26 – Yet another setback for the story of Arianna M., the 15-year-old from Salerno who became quadriplegic, deaf and partially sighted due to a serious case of medical malpractice when she was just three months old: a few hours after the meeting, scheduled for yesterday afternoon, the transaction that would have put an end to the long judicial diatribe was skipped. This was announced by the lawyer Mario Cicchetti, lawyers of Eugenio Manzo and Matilde Memoli, parents of Arianna, who, at this point, decided to ask the Court of Appeal of Salerno, in front of which the second degree proceedings for judgment, to bring forward the hearing scheduled for May 26 “in consideration of the urgency to settle the dispute for the reasons well known to the Court”. The transaction, for over 3 million euros, was blocked, according to what the lawyer of the Manzo family said, due to a communication from the ASL of Salerno (also involved in the affair, ed) with which, he writes Cicchetti, “… the will to reject the hypothesis of a settlement agreement” was expressed.

In a letter sent by the lawyer, among others, also to the general management of the AORN Antonio Cardarelli of Naples, to that of the ASL of Salerno and to the president of the Campania Region Vincenzo De Luca, Cicchetti highlights that the transaction is the result of the contents of the draft of the report of the consultants appointed by the Civil Section of the Court of Appeal of Salerno (whose conclusions were subsequently confirmed in the definitive one) “… which certifies the responsibility of the medical workers employed by AORN Antonio Cardarelli of Naples in the cause of very serious pathologies affecting the minor (already recognized with the sentence issued in 2019 by the Court of Salerno) but also highlighted how that offered to the small by the Salerno ASL had not been adequate “.
