(ANSA) – ROME, MARCH 10 – The failure to provide for the exclusion of the electoral list that does not present candidates of both sexes is unconstitutional for municipalities with less than 5,000 inhabitants. This was established by the Constitutional Court with sentence no. 62, filed today (editor the Vice President Daria de Pretis). The presence of candidates of both sexes in the municipal electoral lists, the Court observes, constitutes a minimum guarantee of equal opportunities for access to elected offices. This obligation also applies to municipalities with fewer than 5,000 inhabitants, only for them the discipline on the presentation of electoral lists does not provide for any sanction in the event of violation. 17% of the Italian population – is therefore ineffective and therefore inadequate to comply with the provisions of article 51, first paragraph, of the Constitution, according to which the Republic promotes equal opportunities between women and men with specific measures.
