(ANSA) – MILAN, 22 JUN – The investigation for aggravated voluntary homicide against Francesco Ciconte, 43, who was arrested on 19 June 2021 for stabbing his brother Vincenzo, 47, must be dismissed for “self-defense” and drug addict, during a dispute and in front of his elderly mother in their home in the San Siro district, in the Lombard capital.

This is the request made by the Milan prosecutor Giovanni Tarzia to the investigating magistrate’s office, now free and defended by the lawyer Niccolò Vecchioni.

That evening, the 43-year-old “found himself involved in a melee with his brother” who “armed with a knife” tried to “hit” him in the vital organs and “wounded, he reacted by defending his mother and himself with another knife”, with a “substantially proportionate, albeit lethal, conduct, that is to say in his turn by delivering a few blows”.

According to the prosecutor, Francesco Ciconte certainly could not “leave the apartment, leaving his mother at the mercy of his armed brother and determined to attack his family”, as he “had repeatedly threatened”, because he insistently asked for more money to buy cocaine. Her mother was not injured “thanks to the timely movement of Francesco” who “dodging her and managed to avoid stabbing”.

The woman, according to the documents, “made a story of the facts substantially compatible” with that of her son Francesco and with what emerged from scientific and medico-legal investigations. Already the investigating judge, releasing the 43-year-old after his arrest and putting him under house arrest, had already spoken of a “tragic family context in which fratricide was consummated”. Now the request for dismissal for the “adequacy of the defensive reaction”. (HANDLE).
