Exploitation of work, seizure of entrepreneurs’ assets in Calabria

(ANSA) – CATANZARO, JUL 13 – The soldiers of the Provincial Command of the Guardia di Finanza of Catanzaro have executed a decree of preventive seizure of assets for 665 thousand euros, issued by the investigating judge of Lamezia Terme at the request of the Public Prosecutor, against two entrepreneurs , directors of three joint stock companies, one of which has now gone bankrupt, operating in the Lametine sector in the large-scale distribution sector and under investigation for exploitation of work to the detriment of 79 employees.

The facts date back to the period between 2016 and 2017. From the investigations, launched by the Group of the Guardia di Finanza of Lamezia Terme and continued with the coordination of the city’s public prosecutor’s office, serious clues emerged against the two entrepreneurs regarding the use of labor in conditions of exploitation. According to what emerged, workers were paid wages in a way that was clearly different from national collective agreements and in violation of the legislation on working hours and taking advantage of their state of need deriving from the absence of further employment opportunities.

Furthermore, the suspects would have required workers to renounce part of their holidays, allowances for employment on holidays and overtime hours, under penalty of non-employment. The conduct would have allowed the entrepreneurs to derive the illegal profits subject to preventive seizure.

The investigations were particularly difficult both due to the initial lack of collaboration of many employees, fearful of retaliation from employers, and because formally the pay slips did not show obvious irregularities.
