Passed at 7, Tar Puglia ‘school reevaluates decision’

(ANSA) – BARI, 28 JUL – The TAR Puglia has suspended the rejection of the Bari student not admitted to the third grade, accepting the precautionary petition of the family and ordering the school to reassess the rejection order. “The non-admission of the minor to the next grade of primary school appears to be configured by the legislator as an extrema ratio admissible only in ‘exceptional cases’ and ‘proven by specific reasons'” notes the TAR. Sharing the considerations raised by the family’s lawyers, the lawyers Giacomo and Roberta Valla, the judges highlighted “that the loss of a school year at such an early age and lacking adequate motivation, assessed in the light of the minor’s exclusive interest, constitutes a serious damage; that a traumatic experience could damage the child’s self-esteem and damage the relationship of trust towards the educational institution; that, moreover, due to the rejection the child would be removed from the class group in which she was integrating ” .
