On Wednesday, January 19, the Pechersky District Court of Kiev elected measure of restraint to the fifth President of Ukraine, the leader of the “European Solidarity” Petro Poroshenko. The politician, suspected of committing high treason and assisting terrorist organizations, the so-called “LDNR”, was released on personal commitment. At the same time, Poroshenko’s property was arrested.

It should be noted that the personal obligation provides for the fulfillment by Petro Poroshenko of certain conditions. Namely:

  • arrival for interrogation at each request of the pre-trial investigation body, prosecutor or court;
  • a ban on travel outside Kiev and the Kiev region without the permission of the investigator, prosecutor or court;
  • be sure to notify the investigator, prosecutor or court of a change in place of residence and place of work;
  • a ban on communication with suspects, witnesses and other persons involved in his case, the list of which is determined by the investigator or prosecutor.

Also, this preventive measure requires the suspect to hand over to the investigating authorities passports and any other documents that allow travel outside Ukraine. In addition, the defendant is also required to wear an “electronic monitoring device” for the location.

What Poroshenko said

The fifth president of Ukraine called the trial “Zelensky’s crazy scenario, as an absolute inadequacy.”

“We came here to demonstrate that we are not afraid of them. In order to demonstrate that the truth is with us. We do not celebrate the victory, although it would seem that we won. We do not celebrate, because Zelensky’s crazy scenario, as an absolute inadequate, has not yet ended”, – Poroshenko said today, January 19, under the court building, thanking his team for the support.

In addition, Poroshenko added that President of Ukraine Volodymyr Zelensky is only his opponent, while Putin is an enemy, and called on the head of the Ukrainian state to unite in the face of a threat from the Russian Federation.

Was the decision of the court expected?

According to Ukrainian political scientists, the preventive measure chosen for Petro Poroshenko came as a surprise to many.

“The dominant assumption among politicians and ordinary citizens was that Poroshenko would be given the same preventive measure as Viktor Medvedchuk – 24/7 house arrest. In this case, the mildest measure of restraint was imposed,” political analyst Alexei Yakubin told Segodnya.

“Few people predicted such a course of events. The decision is unexpected and seems illogical, since all the other defendants in the case have been arrested or are on the wanted list. It turns out that the suspected perpetrators received harsher sentences, and Poroshenko, who is accused of organizing a crime, was given the mildest measure of restraint” , – Bortnik tells us.

Why did the court make this decision?

According to Yakubin, the authorities decided to minimize protest moods within the country and avoid provocations.

“If a convoy arrived at the court to deliver Poroshenko to the pre-trial detention center, fights between Poroshenko’s supporters and law enforcement officers could break out. During an external threat from Russia, the Ukrainian authorities do not need destabilization within the country,” Yakubin explains.

Ruslan Bortnik also does not rule out that the street pressured the court’s decision.

“Such a measure of restraint looks like an excuse for the authorities for an unsuccessful attempt to arrest an opponent,” says Bortnik.

At the same time, the political scientist believes that Poroshenko is also indebted to Ukraine’s Western partners for today’s exit from the court.

“The authorities were under pressure to reduce the pressure on Poroshenko so as not to rock the country, which is on the verge of war with Russia, and not to split the people at a time when Ukrainians should be united to protect against a possible invasion by Moscow,” says Bortnik.

About the same “Today” says political scientist Vadim Karasev.

“After such demands, to arrest Poroshenko in day of arrival to Kiev US Secretary of State Anthony Blinken would mean worsening relations with America. Western pressure on the Office of the President began on January 17, which is why the court decision was postponed. It took time to think everything over and consult,” says Karasev.

What does the court decision mean for Poroshenko

Aleksey Yakubin notes that the election of a soft measure of restraint cannot be called Poroshenko’s victory.

“This is far from a victory. This is just the beginning of the trial. By imposing a measure of restraint, the court confirmed that there are grounds to suspect Poroshenko of crimes. The fifth president will have to visit investigators frequently, and lawyers will have to prove his innocence,” he says.

Vadim Karasev also notes that Poroshenko remains under the supervision of Themis.

“Foreign business trips are prohibited, financial resources are limited by seizure of property. Yes, and Poroshenko’s image has been hit. After all, according to the status for Poroshenko, as a former president, personal obligations to the court are tantamount to house arrest of people’s deputy Medvedchuk,” says Karasev.

What will happen next

According to political analysts, the authorities decided to take a break in the Poroshenko case and develop the next steps.

“Zelensky at the debates before the presidential elections said to Poroshenko: “I am your sentence.” Now, probably, the authorities, sensing the loss of support from the electorate, tried to remember their promise, but chose not the best time for the trial. However, for now, the President’s Office will consider further steps, today’s court decision will cause yet another disappointment among those voters who voted for Zelensky,” Bortnik said.

At the same time, the political scientist is sure that Poroshenko’s rating will not grow because of the court decision.

“The suspicion of treason, which the court has not yet refuted, will still add a negative attitude towards Poroshenko,” Bortnik concluded.
