The rigid stakes to decide the date of the vote

The date of convocation of the polls, between 60 and 70 days from the dissolution of the Chambers, is determined by precise limits indicated in part in the Constitution and in part in ordinary laws.

“The elections of the new Chambers take place within seventy days from the end of the previous ones” states Article 61 of the Constitution. In the event of early dissolution, Article 88 first paragraph of the Charter establishes, the Head of State must first hear the presidents of the two branches of Parliament, which Mattarella will do this afternoon. It is therefore from the date of dissolution by the Quirinale that Palazzo Chigi must calculate the 70 days as the maximum limit for the polls.

The minimum limit was set at 60 days by an implementation law (Presidential Decree 104 of 2003) of the Tremaglia reform which assigned seats in Parliament to Italians residing abroad. In fact, all the procedures for the presentation of the lists, the printing of the ballot papers for the five foreign constituencies, is physically impossible under this timing. On the other hand, even for parties that present themselves in Italy, the procedures for presenting lists and collecting signatures (for parties without parliamentary groups in the two chambers) are laborious, so much so that so far it has never dropped below 63 days from dissolution of the Chambers.

So if Mattarella dissolves already tonight, the possible dates would be a Sunday between September 19 and September 29, then September 25. If instead Mattarella will do as Scalfaro, who in 1994 waited four days between the resignation of Prime Minister Ciampi (January 13) and dissolution (January 16), then October 2 could be included among the options.
