Crac Fse: judgment requested for Bnl leaders, Mit civil party

(ANSA) – BARI, MAY 17 – With the establishment of a civil action by the Ministry of Transport, the Puglia Region, the South East Railways and the State Railways, the preliminary hearing against of 20 defendants for the crash of the South East railways for which the Bari Public Prosecutor’s Office asked for indictment: the former CEO of BNL Fabio Gallia, another 18 between former and current executives and officials of the credit institution, and the former government commissioner, legal representative and sole director of the ESF, Luigi Fiorillo. The accused respond, in various capacities, to improper fraudulent bankruptcy as a result of malicious operations against the ESF and preferential fraudulent bankruptcy in favor of Bnl, with reference to the crash of the Apulian transport company, commissioned after Fiorillo management and then purchased by Ferrovie of the state.

The disputed facts date back to the years 2009-2016, but the alleged bankruptcy crimes are dated January 16, 2017, the date of admission of Fse to the arrangement. In the investigation by the Guardia di Finanza it is hypothesized that the conduct of the credit institution’s officials aggravated the debt situation of Fse through the granting of loans, the maintenance of credit lines in favor of the failing company and the absence of controls on the destination of the sums paid. At the hearing, the prosecutor Roberto Rossi formalized the request for indictment for 19 defendants (the decision of the GUP is scheduled for 21 June), while on 27 September he will discuss the position of the only defendant who requested the shortened procedure, Silvestro Demurtas , at the time the officer in charge of Corporate Loans in the Corporate Banking Division of Bnl.
