Acquitted because ‘masculine’ rape victim, conviction of the Supreme Court

(ANSA) – ANCONA, MAY 31 – Acquitted on appeal, also because the defensive thesis according to which the victim of sexual violence was “too masculine” and therefore “not attractive enough to be rape” had been accepted, two Peruvian citizens , now 27 years old, were definitively sentenced by the Court of Cassation to 5 years and 3 years respectively, the same sentence inflicted in the first instance and then confirmed by a second trial on appeal in Perugia.

On 9 March 2015, the two attacked a twenty-year-old compatriot in Ancona, in a park in the Piano district. The three had spent the evening together in a pub, then had reached the park and there while one abused the girl, the other would act as a stake. Back home, the girl had told her mother what had happened and reported her facts to the police. The accused had been sentenced in the first instance, in 2016, to one to 5 years (the perpetrator of the rape) and the other to 3 years (the stake). In the second instance, at the Court of Appeal of Ancona, three female judges had acquitted them, not considering the reconstruction of the victim credible and supporting the defensive thesis according to which the girl was “too masculine” and therefore “not attractive enough to suffer one rape”. The attackers would not even like her, so much so that they had registered her on the cell phone with the nickname of ‘Vikingo’. The Attorney General Sergio Sottani, at the time in Ancona, had appealed to the Supreme Court and the Supreme Court had sent the documents back to Perugia for the re-trial. The Umbrian judges in 2020 had sentenced the two defendants to the same penalties in the first instance, defended by lawyers Fabrizio Menghini and Gabriele Galeazzi. The judgment was again challenged in the Supreme Court, which in recent days rejected the appeal, confirming the sentence of Perugia. Since Friday the two have been in prison in Montacuto, in Ancona. They always defended themselves that there had been no sexual violence and that it was the girl who allowed herself. The victim was a civil party with the lawyer Cinzia Molinaro. (HANDLE).
