Killed at 15, the Supreme Court admits compensation to parents

(ANSA) – TURIN, 04 AUG – On 30 January 2010, the fifteen year old George Cristian Munteanu was beaten and stabbed to death in a public garden in Turin, under the pretext of a cigarette. Now, twelve years later, the young man’s parents have managed to have the right to “fair and adequate” compensation from the State recognized by the Supreme Court on the basis of a 2004 European directive on intentional and violent crimes: the two perpetrators of the crime (at the time of 17 and 26 years), already condemned definitively, are in fact without financial resources.

The third civil section of the Supreme Court upheld the appeal presented by the Turin law firm Ambrosio and Commodo and overturned the previous first and second degree sentences. The ‘Ermellini’ referred the documents to the Turin Court of Appeal, which will have to quantify the amount of the compensation on the basis of “fairness” and “adequacy” criteria. “It is a very important ruling – explains the lawyer Gaetano Catalano – because he sends a clear signal to the legislator and invites him, between the lines, to adapt the national legislation to the directive”. “The Supreme Court – adds the lawyer Renato Ambrosio – has recognized the validity of our law, providing indications for compensation and opening a very important road”.

The appeal was filed against the Presidency of the Council of Ministers. (HANDLE).
