Poroshenko did not sign the Minsk agreements: what does this mean for Ukraine

The fifth president of Ukraine, Petro Poroshenko, did not sign the Minsk agreements in 2015, and the document itself, in principle, is not part of international law and does not bear legal consequences for Ukraine if it is not implemented.

Andrey Illarionov, former adviser to Russian President Vladimir Putin, stated this in the program “Ukraine with Tigran Martirosyan” on the TV channel “Ukraine 24”.

“Not a legal document”

Ukrainian diplomat and international lawyer Oleksandr Chaly initially stated that according to international law, the Minsk agreements could not be implemented.

To this, the ex-adviser to Putin said that the Minsk agreements are not part of international law.

“The agreements themselves do not belong to the documents of international law. Such documents include treaties, conventions, memorandums, for example, the very same Budapest Memorandum is part of international law. The Minsk agreements do not belong to the section of documents of international law at all. This is not a legal document This is a kind of declaration, statement, communiqué, which is not followed by legal responsibility,” Illarionov said.

He explained why Ukraine is not obliged to strictly comply with it.

“This document was not signed by the then President of Ukraine, Petro Poroshenko. Poroshenko did not sign a document called the Package of Measures. Poroshenko signed another document – a statement by the presidents, in which there was a reference to this document. But this document itself was not signed by the President of Ukraine. From the point of view of international law, this document has no legal value. Therefore, the rejection of the Minsk agreements, the failure to implement the Minsk agreements does not entail any legal consequences for Ukraine,” Illarionov stressed.

Recall that Petro Poroshenko previously stated that under the Minsk agreements there is the signature of Russian President Vladimir Putin, and now Russia “can be held accountable in the International Court of Justice for failure to fulfill its obligations.”
