Justice, the compact Anm votes the strike against the Cartabia reform

Compact and strong thanks to a vote that gathered a ‘Bulgarian’ majority around a unitary and collective motion, the National Association of Magistrates led by Giuseppe Santalucia and Salvatore Casciaro leaves behind the defeat of the ‘Palamara and friends’ case, and marches decided with renewed pride towards identifying the date on which to call strike day – against the Cartabia reform of the judiciary – to which the robes gave the green light with 1081 votes in favor, 169 against and 13 abstentions, after an eight-hour debate in which also parliamentarians expert in the justice sector participated as guests.
In order not to be “intrusive” in such a delicate moment, the Keeper of the Seals Marta Cartabia declined the invitation to the togas meeting, sending however her chief of staff Raffaele Piccirillo and keeping the door of dialogue open with a message at an anti-mafia convention in which he wrote that “our judiciary is a defense of our democratic life”.
“For me, the reform should not be closed like this: my idea is that it is a mild reform, it needs to be much more incisive, it needs to be improved in the Senate and some technical ideas that I heard here today can also be taken into consideration” , said Giulia Bongiorno of the League – ready to question the text of the reform at Palazzo Madama – underlining that “the heart of the political problem is whether or not this reform will be changed in the Senate: because on the one hand there is the need of the upcoming elections of the CSM and of those who want them to take place in July with the new rules, but I believe that the reforms must be incisive otherwise it is better not to do them “.
It is probable that the abstention from the hearings, which could be followed by other ‘replies’ if the policy does not listen, will take place before the Senate approves the reform, around 20 May. “We have witnessed the accentuation of the criticalities of the reform” and “we are here to find forms of protest, which are also through acts” that externally manifest “the reasons” for our objections to the reform which “will be useless and I believe also harmful” , Santalucia underlined in his speech to the assembly in “extraordinary call” and that he counted on the participation in the vote of over 1423 robes, also by proxy. In all, the magistrates are just under 10 thousand, and 96% are members of the Anm.
“It is a reform permeated by corporate logic, – continued the secretary Casciaro – which aims at efficiency and thinks of courts as assembly lines, which provide, possibly quickly, a product, no matter whether or not it is quality: a reform that profoundly alters the constitutional model of the judge “and that” is animated by the resentment “of politics, despite thirty years have passed since Mani Pulite.
Giulia Sarti, much applauded, took care of the risk of changes to the reform in the Senate. “The danger – said the Cinquestelle parliamentarian – is that if the debate in the Senate on the reform of the judiciary is reopened, there will not be a majority in the numbers like the one that has so far managed to avoid the direct responsibility of the magistrates and the zeroing of the transfer of functions. The complexity of the positions and their heterogeneity has led and leads Parliament to make reforms also made up of things that we have managed to avoid “. “I hope that if it is not in the Senate, it will be in the implementing decrees” that there may be “changes”, added Sarti.
No ‘hand extended’ by Enrico Costa of Action who immediately rejected the strike, “it is wrong” and lashed the magistrates “to reflect on the dramatization of the effects with respect to the reforms in the field” recalling that the much feared reform on the indirect responsibility of robes in 12 years it has led to only eight ‘convictions’. The leader of the criminal lawyers is in the same vein.
“There is no other country in the world – said the president of the Criminal Chambers Gian Domenico Caiazza – where for each government that is formed 200 magistrates are put out of office, and you are silent about all this. of the legislative office of the ministry are judges and not those belonging to the career civil servant. You cannot lock yourself in a fort for which every reforming change is experienced as an assault “.
