The Supreme Court of United States made a controversial decision by authorizing the prohibition of transgender people to serve in the US Army, a measure initially decreed by the then president Donald Trump. This decision, which has been the target of intense court disputes, now allows more than 4,000 transgender military personnel to be exempt from their duties and prevents new transgender recruits from entering the Armed Forces. The decision was made by a conservative majority, following a request from the Department of Justice to suspend the injunction that blocked the implementation of the measure.
The decision was not unanimous and found resistance within the Supreme Court itself. Three liberal judges, Sonia Sotomayor, Elena Kagan and Ketanji Brown Jackson, publicly expressed their disagreement with the decision. Civil rights groups, such as Legal Lambda and Human Rights Watch, classified the decision as a drastic setback and a devastating blow to the transgender military. According to these organizations, the measure is not related to military readiness, but rather to prejudice, and state that Trump’s policy in January distorts reality by stating that gender identity does not correspond to biological reality.
The Supreme Court’s decision reversed previous determinations of Washington and Seattle federal judges, who had suspended Trump’s policy for finding it unconstitutional. White House Secretary Caroline Leavitt celebrated the decision as a “massive victory.” The prohibition of transgender people in the army was one of Trump’s campaign promises and is now materialized with the approval of the Supreme Court, generating heated debate on transgender rights and US military policy.

LGBTQ+ Rights Defense Groups estimate that the number of transgender military personnel is even higher than officially registered, which makes the decision even more impactful. The measure raises questions about inclusion and equality within the Armed Forces, as well as provoking discussions about the role of gender identity in American society.
