The Justice of Spain once again rejected an appeal from the Brazilian government that asked for the extradition of the blogger supporter of Jair Bolsonaro, Oswaldo Eustáquio. The 3rd Section of the Spain National Home Penal Room understood that Brazil has no legitimacy to resort directly from the previous negative. In the order, the magistrates stated that only Eustáquio himself or the Spanish prosecutor could appeal against the decision that rejected extradition on April 14. To Brazil, according to the Court, it would only be responsible for “adhering” to one of these resources, not being a formal part in the process. The argument reinforces the position already expressed in the previous judgment, which had denied extradition because it see “political motivation” in the request made by the Brazilian authorities.

Eustáquio is considered a fugitive from Brazilian justice and is the target of investigations for crimes such as threat, persecution, incitement to crime, criminal association and attempt to abolish, by violent means, the Democratic Rule of Law, on January 8, 2023. The Justice of Spain denied the Brazilian government’s request to extradite Oswaldo Eustáquio, 46, on April 14. The decision of the 3rd Criminal Section of the National Hearing says that the facts attributed to Eustachian would have “evident connection and political motivation”, which would prevent their delivery to Brazil based on the treaty between countries.
