Passengers involved in the air inconveniences linked to Fault at the North-West Radar Center of ENAV have the right to reimbursements and assistance, as required by EC Regulation 261/2004. This was stated by the company specialized in Air Transport Reimbrocciaalvolo.
Even in exceptional circumstances such as the one recorded yesterday, if the flight is canceled or undergoes prolonged delay, the airline has the obligation to guarantee assistance to passengers in the form of meals and drinks in relation to the duration of the wait, accommodation in the hotel in the event that one or more overnight stays are needed, transfer from the airport to the place of accommodation and vice versa, two telephone calls or messages via telex, fax or e -mail. If the assistance is not guaranteed and the passenger has had to pay meals, drinks, taxis or hotels, the airline must reimburse the expenses incurred, provided that it is reasonable and appropriate: for this purpose it is good to keep all the receipts attesting these expenses, preferably named, especially for taxis – explains RimadoAlvolo.
In the event that a flight has been canceled due to the black out, the airline must offer the choice between: the reimbursement of the ticket and, in the event of a coincidence, a return flight to the departure airport as soon as possible; Boarding on another flight towards the final destination as soon as possible, or boarding on another flight on a later date.
“On the other hand, pecuniary compensation is not foreseen up to 600 euros per passenger: since it is a case of force majeure, the delay or cancellation of the flight is not attributable to the liability of the airline”, specifies Kathrin Cois, general manager of Rimadalvolo.
