Islamic Center wins against Ventimiglia Municipality, remains where it is

(ANSA) – VENTIMIGLIA, 04 AUG – The “Islamic Brotherhood” cultural center of Ventimiglia has won a long-standing legal battle against the Municipality. The Council of State, in fact, confirmed the sentence of the Liguria TAR which gave reason to the promoters of the appeal, who had opposed the administration’s refusal to keep the headquarters in via Aprosio, in the city center. The filing of the sentence took place this morning, as confirmed by the lawyer Paolo Gaggero, who assists the applicants of the center.

As far as we know, the Municipality, in considering the permanence of the cultural center illegal, had provided a too restrictive interpretation of the Ligurian legislation on religious centers. Among other things, the resolution disputed the lack of some urban planning requirements of the structure.

The Council of State, however, decided not to apply the legislation in such a severe way, risking to conflict with constitutional principles and the cultural center can remain in the city center, next to the headquarters of the police station. (HANDLE).
