Political-Diplomatic Protection given by President Luiz Inacio Lula da Silva to former Peru Nadine Herediacondemned in case of corruption involving the Operation Lava Jetgenerated immediate political wear to the petista. The political asylum, followed by a refuge request that in practice blocks its extradition, yielded four opposition collection fronts in Brazil.

Parliamentarians suggested the opening of investigations by the Attorney General’s Office (PGR) and the Federal Court of Audit (TCU). In addition, they want to call Chancellor Mauro Vieira to provide explanations in the House and requested written information to Itamaraty. In all, the House of Representatives has already registered six legislative proposals related to Lula’s diplomatic and political action, in relief to Nadine Heredia. The defense denies any irregularity.

Deputy Evair de Melo (PP-ES), author of four of them, suggested to the PGR the investigation of possible irregularities in the granting of the diplomatic asylum and the use of public resources in the transportation of it by the Brazilian Air Force (FAB). He also suggested the call for the minister to provide clarification at a public hearing.

The chairman of the Foreign Relations and National Defense Commission, Filipe Barros (PL-PR), asked the TCU to perform an audit on the expenses and regularity of the employment of the FAB, which has moved a jet to seek the former first lady in Lima and transport it, as well as his son, to Brasilia.

Already the deputies of the New Adriana Ventura (SP) and Marcel Van Hattem (RS) requested Itamaraty information about Lula’s decision. Parliamentarians want to know, for example, what supported the decision of the Brazilian government and if a future extradition, at the request of the neighboring country, is considered. Both inquire also have any prior assessment of impacts on bilateral relationships with Peru.

For Ventura and Van Hattem, “the urgency of the situation was invoked, but the decision occurred hours after the judicial conviction and order of arrest, without having been publicly submitted clear evidence of political motivation in persecution or risk to the applicant’s life or integrity.”

“Transparency and respect for the rule of law require that we clarify criteria used by Brazilian diplomacy for this concession, which has relevant impacts on bilateral relations with Peru and International Positioning of Brazil to combat corruption and impunity,” said the new deputies of the new.

On the other hand, lawyer Marco Aurélio de Carvalho, who represents Nadine in Brazil discarded any irregularities in the protection given to former first lady or the use of the FAB plane, noting that it would be the country’s responsibility to remove it from Peru after granting the asylum.

“Opposition is trying to create a political fact. It has no foundation (the request for investigation). The asylum was granted within the rules,” he said, adding that he sees no concrete impacts for the case of Nadine Heredia. “Opposition wants to scream and has the right to do this. Just as the government has the right to do what it thinks should be done within the rules established by international conventions,” he concluded.

Nadine Heridia and former Peruvian president Ollanta Humala were sentenced to 15 years in prison, accused of receiving illegal campaign contributions from Odebretch and the Venezuelan government worth $ 3 million. By announcing the sentence on Tuesday, 15, the court ordered the couple’s immediate arrest, but only Humala was present in court. Nadia, on the other hand, nursed at the Brazilian Embassy in Lima and asked for refuge after arriving in the country.

“The Brazilian Embassy was full and fully informed about the sentence of Mrs. Heredia for the crime of money laundering,” said Foreign Minister Elmer Schialer on the asylum, noting that Peru was obliged by the Caracas Convention to grant the immediate save for Nadine to leave the country after the asylum. “This decision was made in strict compliance with Peru’s international obligations.”
